A. INTRODUCTION

This is the privacy policy (“Privacy Policy”) of MY CITY TECHNOLOGY (202003086443, 003097054-X) and MY City app (including all of its subsidiaries, brands, related and/or associated companies/brands). These entities are collectively referred to as "MY City", “MY City app”, “My Dream City”, “we”, “us” or “our”. MY CITY is committed to respecting and protecting your privacy online. This Privacy Policy explains our practices regarding the collection, use, disclosure and transfer of your personal data.

ii. This Privacy Policy is incorporated as part of the MY CITY app’s Terms of Use. Your use of the Platform and/or Service is subject to the Terms of Use and this Privacy Policy. Unless specifically defined in this Privacy Policy, the defined terms shall have the same meaning as defined in the Terms of Use.

iii. To process, administer and/or manage your relationship with us, we will necessarily need to collect, use, disclose and/or transfer your personal data. This Privacy Policy applies to personal data about you (MY CITY app members/users, MY CITY’s Partners, business/marketing partners, agents, vendors, distributors, suppliers, contractors, service providers, etc) and/or individuals provided by you, possessed by us or that we obtain about you, whether now or in the future. We will only process your personal data in accordance with the prevailing personal data protection and privacy laws of the countries we operate in and this Privacy Policy.

iv. If you are a company, an entity or an organization, references to the term “you” and “your” shall also include your employees, representatives and agents.

v. By accessing, browsing, downloading and/or using our Platform and/or Service, or by dealing with us, you acknowledge that you have read and understood this Privacy Policy and agree to us processing your personal data in accordance with the manner as set out in this Privacy Policy, amended from time to time.

vi. We may revise or update this Privacy Policy at any time by posting a revised/an updated version on the Platform/app. Unless stated otherwise, any revision or update takes effect immediately. Your continued access and/or use of our Platform and/or Service or dealing with us after a revision or update to this Privacy Policy constitutes your binding acceptance of the revised or updated Privacy Policy.

vii. It is necessary for us to collect and process your personal data. If you do not provide us with your personal data, or do not consent to this Privacy Policy or any amendments to this Privacy Policy, we may not be able to render all services to you and you may be required to terminate your relevant agreement with us and/or stop accessing or using the Platform and/or Service.

viii. This Privacy Policy applies to websites, apps, events and other services operated by MY CITY. For simplicity, we refer to all of these as “our” services in this Privacy Policy. To make it extra clear, we’ve added links to this Privacy Policy on all applicable services.

ix. Some services may require their own unique privacy policy. If a particular service has its own privacy policy, then that policy -- not this Privacy Policy – applies.

B. COLLECTION OF PERSONAL DATA

i. The term “personal data” means any information in our possession or control that relates directly or indirectly to an individual to the extent that the individual can be identified or is identifiable from that information such as name, address, telephone number, passport/identification card number, date of birth, email address, gender, race, bank details, credit/debit card details, etc. The types of personal data collected depend on the purpose(s) of collection. We may “process” your personal data by way of collecting, recording, holding, storing, using, disclosing and/or deleting it.

ii. Your personal data may be collected from you during your course of dealing with us in any way or manner including pursuant to any transactions and/or communications made from/with us. We may also collect your personal data from a variety of sources, including without limitation, at any meetings, events, activities, contests, customer satisfaction surveys organised and/or sponsored by us, as well as from publicly available sources such as directories and MY CITY app’s social media pages, if you follow, like or are a fan of such pages. Further information may also be collected when we exchange communications with you, for example, if you submit a request, file a complaint or contact our support team.

iii. In addition, we may also receive, store and process your personal data which are provided or made available by any third parties whom you have authorised, credit reference/reporting bodies, regulatory and law enforcement authorities, for reasons including delivery of our Service, performance of conditions of agreements and/or to comply with our legal and regulatory obligations.
iv. Some of the information that you submit may be personally identifiable information (that is, information that can be uniquely identified with you).
v. First, in order to participate in the MY CITY job platform, you must download MY CITY app. When you register an account on MY CITY app, MY CITY collects certain personally identifiable information, including your name, address (physical and email), and general educational and professional background ("Member Information").
vi. Second, to begin using MY CITY job platform, you will be asked to register by opening a personal user account. Through the online registration form certain information, including job type, salary range, desired location of employment and your resume ("Registration Information") is collected. An asterisk indicates which information is mandatory in order to complete the registration process.
vii. Third, if you choose to submit information for a particular job posting, you may be asked to complete a more extensive employer-specific questionnaire (an "Employer Questionnaire") to provide additional information to fine-tune your qualifications and candidacy for that specific job posting ("Candidacy Information").
viii. Your Membership Information, Registration Information and Candidacy Information are collectively referred to below as your "Employment Information."
ix. We collect the following general types of information about you when you visit our Sites/mobile applications: personal information, demographic information, behavioural information, and indirect information. Sometimes we collect combinations of all these types of information.
x. We do not collect personal information unless you choose to provide it to us as stated above.
xi. Demographic information is information that is not unique to you in the sense that it refers to selected population characteristics, such as your ZIP code or postal code, age, preferences, gender, race or ethnicity, occupation, career history, interests and favourites.
xii. We also collect behavioural information regarding how you use our site and mobile applications, the areas of our site/mobile applications that you visit, what services you access, and information about your computer/mobile applications hardware and software including your IP address, geolocation, browser/mobile applications and operating system type, domain names, access times and referring Web site/mobile applications addresses. This information is necessary for analysing the use of resources, troubleshooting problems, preventing fraud, and improving our services.
xiii. In addition, MY CITY app may collect indirect information about you when you use certain third-party services on the MY CITY app job platform and the collection of such information is considered necessary for that purpose.
xiv. We may personalize the advertising that you are shown on the MY CITY app job platform with which we have a business relationship. In order to provide this personalization, in addition to information we collect about you on MY CITY app job platform, we acquire information (including personal, demographic, behavioural and indirect information) about you from third parties who provide it to us.
C. PURPOSE OF ACQUIRING AND PROCESSING YOUR PERSONAL DATA

1. The personal data as provided/furnished by you to us or collected by us from you or through such other sources as may be necessary for the fulfilment of the purposes at the time it was sought or collected, may be processed for the following purposes (collectively referred to as the “Purposes”):
Where you are a MY CITY app member/user:
· To register for a user Account with us;
· To process, manage or verify your identity;
· To provide, maintain and improve the Platform and/or Service to you;
· To fulfil and validate your purchases/reservations/bookings;
· To process payment from you, including authorising and processing online banking, credit/debit card transactions and sending receipts to you;
· To communicate with you and to maintain and improve customer relationship;
· To personalise and improve your user experience with the Platform and/or Service;
· To provide you with support and handle requests and complaints;
· To facilitate your participation in, and our administration of, any of our activities including contests, promotions, campaigns, polls or surveys;
· To conduct market research or surveys, internal marketing analysis, customer profiling activities, analysis of customer patterns and choices, usage and activity trends analysis in relation to the Platform and/or Service and our users’ demographics (on an anonymised basis);to protect and/or enforce our legal rights and interests, including defending any claim;
· To comply with our legal and regulatory obligations under the applicable laws, legislation, regulations or court orders;
· To comply with or as required by any request or direction of any governmental/law enforcement authorities; or responding to requests for information from public agencies, ministries, statutory bodies or other similar authorities;
· To detect, investigate and prevent any fraudulent, prohibited or illegal activities or misuse of the Platform and/or Service;
· To transfer or assign our rights, interests and obligations under any agreements entered with us;
· For internal administrative and updating purposes, such as auditing, data analysis, record keeping, contact lists, risk management, security, etc; and/or
· For our storage, hosting back-up (whether for disaster recovery or otherwise) of your personal data, whether within or outside your country,
and you agree and consent to us using and processing your personal data for the Purposes as identified in this Privacy Policy.
Where you are our MY CITY app Partner, business/marketing partner, agent, vendor, distributor, supplier, contractor or service provider:
· To engage you to provide products and/or services to us/on our behalf;
· To process any payments related to your commercial transactions with us;
· To communicate with you and to maintain and improve customer relationship;
· To provide you with support and handle requests and complaints;
· To conduct credit reference checks and establish your credit worthiness,
· To carry out due diligence or other monitoring or screening activities (including background checks) in accordance with legal or regulatory obligations or risk management procedures that may be required by law or that may have been put in place by us;
· To send you seasonal greetings messages, gifts, newsletters from time to time;
· To protect and/or enforce our legal rights and interests, including defending any claim;
· To comply with our legal and regulatory obligations under the applicable laws, legislation, regulations or court orders;
· To comply with or as required by any request or direction of any governmental/law enforcement authorities; or responding to requests for information from public agencies, ministries, statutory bodies or other similar authorities;
· To detect, investigate and prevent any fraudulent, prohibited or illegal activities or omission or misconduct;
· To transfer or assign our rights, interests and obligations under any agreements entered with us;
· For internal administrative and updating purposes, such as auditing, data analysis, record keeping, contact lists, risk management, security, etc; and/or
· For our storage, hosting back-up (whether for disaster recovery or otherwise) of your personal data, whether within or outside your country,
2. Marketing and promotional purposes

i. We may also use and process your personal data for the following marketing and promotional purposes (“Marketing and Promotional Purposes”):
· To send you information, alerts, newsletters, updates, promotional materials, special privileges announcements on products, services, upcoming contests, events, activities, promotions, campaigns, polls or surveys offered/organised by us and/or our selected third parties (business/marketing partners, sponsors, advertisers) which may be of interest to you;
· To send you seasonal/festive greetings or messages;
· To notify and invite you to events or activities organised by us and/or our selected third parties (business/marketing partners, sponsors, advertisers) which may be of interest to you;
· To process your registration to participate in or attend an event or activity and to communicate with you regarding your attendance at the event or activity; and/or
· To share your personal data within our organisation and our selected third parties (business/marketing partners, sponsors, advertisers) who may communicate with you to market their products, services, events or promotions, from time to time by SMS, phone call, email, fax, mail, social media and/or any other appropriate communication channels.
· You have the right at any time to request us to stop sending you any marketing and promotional materials or contacting you for Marketing and Promotional Purposes. You may also click on the “Unsubscribe” link embedded in the relevant marketing and promotional email in order not to receive any marketing and promotional email in the future. If you unsubscribe, we may still send you non-marketing and promotional communications, such as those about your Account, about the Platform and/or Service or our ongoing business relations.
ii. If you are a MY CITY app member, your user profile information such as your username will be used to identify you when you use the Platform and/or Service. Your username may be displayed to other users when you submit your rating and/or review. We will not directly disclose or share your user email address and other information without your consent.
iii. We may also use, process and share non-personally identifiable, aggregated, statistical and/or anonymous data with third parties for data analytics and to analyse and develop our marketing strategy and further improve and enhance the Platform and/or Service.
iv. You agree and consent to us using and processing your personal data for the Purposes as identified in this Privacy Policy.
v. We will seek your separate consent for any other purposes which do not fall within the categories stated above.
3. MY CITY app job platform
Your Employment Information together with your personal information, demographic information behavioural information and indirect information are hereinafter referred to as your “Personal Data”. The provision of your Personal Data is voluntary. However, if you do not provide MY CITY app with your personal data, MY CITY app will not be able to process your Personal Data for the Purposes outlined below.
MY CITY app may use and process your personal Data for business and activities which shall include, but not limited to the following: -
i. For the Jobseeker
Once you have activated your MY CITY app job platform personal user account, MY CITY submits your Registration Information to the MY CITY app job platform engine to attempt to match your information with available job postings. Upon a match of your Registration Information with a job posting, MY CITY will notify you via email if you have elected to receive such notifications. Upon reviewing a job posting, your Employment Information will be forwarded to that potential employer only if you click on the "Apply" or "Submit" button, thereby instructing MY CITY app to forward the Employment Information to the potential employer.
ii. By the Potential Employer
MY CITY app has granted potential employers the ability to run searches through the MY CITY app job platform engine to match their job postings with jobseekers' Registration Information. No personally identifiable information is released to these potential employers during these searches, and potential employers are not able to contact jobseekers through this portion of the MY CITY app job platform. Notwithstanding the foregoing, by agreeing to use our services, your Employment Information may be shared with a potential employer, the potential employer will have access to your Employment Information and has agreed to treat that information as confidential and to not disclose it to any third party without your prior written consent.
iii. For the Employer
Once you have signed up for an account with MY CITY app job platform, the information you provided will be used to perform MY CITY app job platform’s obligations in respect of any contract entered into with you, to facilitate and/or provide you with any service you have requested as envisaged under the Site/mobile applications and to process your information to create your employer page with the Site/mobile applications for jobseekers to gain basic information about the employer. The information is also used to validate payment made by the employer relating to services and products requested from the Site/mobile applications and to process cancellations and/or refunds for the services that have not been rendered to you, where applicable, subject to other specific terms and conditions for the services. MY CITY may use the information to understand and analyse our sales as well as your needs and preferences to improve MY CITY app job platform’s services to you, to develop, enhance and provide products and services to meet your needs or to contact you for product or customer satisfaction surveys and market research; and for all other purposes ancillary to any of the purposes stated above.
iv. Third Parties
MY CITY has contracted with a third-party Application Service Provider (ASP) to implement and host the MY CITY app job platform. Information collected from you and potential employers will be stored on the ASP's server and processed through its profiling engine. The ASP is not permitted to disclose your personally identifiable information to any third party without your consent.
D. CONSEQUENCES OF NOT CONSENTING TO THIS PRIVACY POLICY/NOT PROVIDING YOUR PERSONAL DATA
The collection of your personal data by us may be mandatory or voluntary in nature depending on the Purposes for which your personal data is collected. Where it is mandatory for you to provide us with your personal data, and you fail or choose not to provide us with such data, or do not consent to the above or this Privacy Policy, we will not be able to provide our Platform and/or Service to you (if you are a MY CITY app member) or engage you to provide products and/or services to us or on our behalf or issue payments to you for products and/or services provided (if you are our MY CITY app Partner, business/marketing partner, agent, vendor, distributor, supplier, contractor or service provider).
E. DISCLOSURE OF YOUR PERSONAL DATA
i. By registering with MY CITY app, by managing your profile, or opting in when presented with choices, you have explicitly consented for us to use your information, subject to local law, in the following ways:
· To allow you to create an account; to create a profile for you based on information that you have provided to MY CITY app job platform;
· To contact you about MY CITY app job platform updates, informational and service-related communications, including important security updates;
· To provide you additional communications, information, and promotions such as newsletters and career advice;
· To inform you of other products or services available from MY CITY app;
· To enable you to provide feedback, to contact us and for us to respond to you; to conduct surveys, questionnaires, promotions and contests, and to provide the results thereof such as success stories and contest winners; to provide information about you and your potential interest in job postings to employer customers;
· To provide products and services to employer customers to complete the recruitment and hiring process, such as accessing the searchable resume database; to provide products and services that enable users to network, post information on bulletin boards, view and compare profiles, and career background and experience; to generate internal reports about the use of our site/mobile applications; and to provide 'forward to a friend' features.
ii. Some of our products and services, such as our searchable resume database and networking, enable third parties to see your personal information and to contact you.
iii. Profile information may be used for networking with other community members or may be visible to employers who are using the MY CITY app job platform. In addition, portions of your searchable resume (but not your contact information) may be made public in your networking profile.
iv. Information you post in public areas of the site/mobile applications or place in the searchable resume database will be accessed, used, and stored by others around the world, including those in countries that might not have legislation that guarantees adequate protection of personal information as defined by your country of residence.
v. By providing your personal information for inclusion in our database, you acknowledge that you consent to your information being used as described here. While MY CITY app takes measures to safeguard your information from unauthorized access or inappropriate use by third parties, MY CITY does not control these third parties and we are not responsible for their use of information you post or otherwise make available in public areas of the MY CITY app job platform. Accordingly, you should ensure that you do not post sensitive information, including personality profiles, to the Site/mobile applications.
vi. We will not sell, rent, transfer or disclose any of your personal data to any third party without your consent. However, we may disclose some of your personal data to the following third parties, for one or more of the above Purposes:
· Our subsidiaries, related and/or associated companies;
· Your immediate family members and/or emergency contact person as may be notified to us from time to time;
· Successors in title to us;
· Our fitness and wellness centres, gyms, classes, studios, sport complexes, li outdoor group exercises and activities partners (“Partners”) for each offer that you reserve on the Platform, as if you reserved an Activity directly with the MY CITY app Partner;
· Our selected third parties (business/marketing partners, sponsors, advertisers) who offer promotions or organise contests, events, activities or campaigns;
· Any person under a duty of confidentiality to which has undertaken to keep your personal data confidential which we have engaged to discharge our obligations to you;
· Any party in relation to legal proceedings or prospective legal proceedings;
· Auditors, consultants, lawyers, accountants or other financial or professional advisers appointed in connection with our business on a strictly confidential basis, appointed by us to provide services to us;
· Any party nominated or appointed by us either solely or jointly with other service providers, who provide services or conduct data processing on our behalf, or for data centralization and/or logistics purposes;
· Data centres and/or servers located within or outside your country for data storage purposes;
· Storage facility and records management service providers;
· Government agencies, law enforcement agencies, courts, tribunals, regulatory/professional bodies, industry regulators, ministries, and/or statutory agencies or bodies, offices or municipality in any country, if required or authorised to do so, to satisfy any applicable law, regulation, order or judgment of a court or tribunal or queries from the relevant authorities;
· Credit reference/reporting agencies for the purpose of credit checking on you;
· Our business/marketing partners, third party product and/or service providers, suppliers, vendors, distributors, contractors or agents, on a need to know basis, that provide related products and/or services in connection with our business on our behalf or to assist us with the provision of the Platform and/or Service to you;
· Insurance companies for the purpose of applying and obtaining insurance policy(ies), if necessary;
· Financial institutions for the purpose of applying and obtaining credit facility(ies), if necessary;
· Banks and financial institutions, merchants and credit/debit card companies in connection with your commercial transactions with us;
· The general public when you become a winner in a contest, participate in our events or activities, submit your rating and/or review or other features of the Platform and/or Service that are viewable by the general public without compensation for advertising and publicity purposes;
· Any third party (and its advisers/representatives) in connection with any proposed or actual reorganization, merger, sale, consolidation, acquisition, joint venture, assignment, transfer, funding exercise or asset/share sale relating to all or any portion of our business or in the unlikely event of insolvency, bankruptcy or receivership; and/or any other person reasonably requiring the same in order for us to operate and maintain our business or carry out the activities set out in the Purposes or as instructed/authorised by you.
F. ACCURACY OF YOUR PERSONAL DATA
We take it that all personal data provided by you is accurate and complete, and that none of it is misleading or out of date. You will promptly update us in the event of any change to your personal data. Please note that your failure to maintain accurate, complete and up-to-date personal data (including having an invalid or expired payment method) may result in your inability to access and use the Platform and/or Service.
G. YOUR RIGHTS
i. To the extent that the prevailing personal data protection and privacy laws of the countries we operate in allow, you have the right to request for access to, request for a copy of, request to update or correct, your personal data held by us. We may charge a small fee (such amount as permitted under the applicable law) to cover the administration costs involved in processing your request to access your personal data. Notwithstanding the foregoing, we reserve our rights to rely on any statutory exemptions and/or exceptions to collect, use and disclose your personal data.
ii. In addition, you also have the right, by notice in writing, to inform us on your withdrawal (in full or in part) of your consent given previously to us subject to any applicable legal restrictions, contractual conditions and a reasonable duration of time for the withdrawal of consent to be effected. However, your withdrawal of consent could result in certain legal consequences arising from such withdrawal. In this regard, depending on the extent of your withdrawal of consent for us to process your personal data, it may mean that we will not be able to continue with your existing relationship with us or the contract that you have with us will have to be terminated.
iii. You may correct, update or delete your personal data at any time by editing your profile on the “Account Settings” page on the Platform. However, please note that your personal data may be retained on our back-up systems for some time. In addition, you cannot delete information associated with past transactions as we keep track of these records.
H. RETENTION OF YOUR PERSONAL DATA
i. Any of your personal data provided to us is retained for as long as the purposes for which the personal data was collected continues; your personal data is then destroyed or anonymised from our records and back-up systems in accordance with our retention policy in the event your personal data is no longer required for the said purposes unless its further retention is required to satisfy a longer retention period to meet our operational, legal, regulatory, tax or accounting requirements.
ii. We use the information we gather on the MY CITY app job platform, whether personal, demographic, collective or technical, for the purposes of operating and improving the MY CITY app job platform, fostering a positive user experience, and delivering the products and services that we offer.
iii. If you have provided consent for us to do so, we may also use the information we gather to inform you of other products or services available from us or our affiliated companies or to contact you about your opinion of current products and services or potential new products and services that may be offered.
iv. We may use your contact information in order to send you e-mail or other communications regarding updates at the Site/mobile applications to contact you about your opinion of current products and services or potential new products and services that may be offered.
v. MY CITY app cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. Therefore, although we are committed to protecting your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private. As a user of the MY CITY app job platform, you understand and agree that you assume all responsibility and risk for your use of the Site/mobile applications, the internet generally, and the documents you post or access and for your conduct on and off the Web Site and mobile applications.
I. DISCLOSOSURE OF YOUR PERSONAL DATA (JOB PLATFORM ONLY)
We disclose to third parties within your country and abroad your personal information, combined personal, demographic, behavioural or indirect information, as set forth below:
i. We disclose your resume to employers who have posted job opportunities that may be of interest to you on the MY CITY app job platform when you apply for those jobs. We may share your information with third parties who help us in the delivery of our own products and services to you.
ii. We disclose information to companies and individuals we employ to perform functions on our behalf. Examples include hosting our web servers, analysing data, providing marketing assistance, processing credit card payments, and providing customer service.
iii. These companies and individuals may be located in a country whose data protection legislation is different from your country, and they will have access to your personal information as necessary to perform their functions, but they may not share that information with any other third party or use that data for any other purpose.
iv. We will remain responsible for any information shared in this way. We disclose information to third parties if you consent to such disclosure. For example, if you make your resume searchable, then all parties with access to our searchable resume database (or copies thereof) will have access to your resume.
v. If you indicate that you would like to receive information about the opportunities, products or services of third parties at the time you register for a MY CITY app account, we supply your contact information to third parties such as employers, recruiters, data aggregators, marketers or others for the purpose of sending you e-mail or otherwise communicating with you.
vi. We use data we have about you (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities, products or services of a third-party. For example, if you indicate that you would like to receive information about the opportunities, products or services of third parties at the time you register for a MY CITY app account, we supply your contact information to third parties such as employers, recruiters, data aggregators, marketers or others for the purpose of sending you e-mail or otherwise communicating with you.
vii. We also share aggregated anonymous information about visitors to the MY CITY app job platform with MY CITY app's clients, partners, other Site/mobile applications visitors, and other third parties so that they can understand the kinds of visitors to the Sites/mobile applications and how those visitors use the Sites/mobile applications in order to serve advertisements to you on our Sites/mobile applications or other sites/mobile applications with which we have a business relationship.
viii. We may also aggregate on an anonymous basis data regarding job qualifications, schooling, age, experience level or other information relevant to the job search or competition among job seekers for any such job. Such aggregated data does not identify users individually and may be made available to employers or fellow job seekers or community members.
ix. We disclose information to companies and individuals we employ to perform functions on our behalf. Examples include hosting our web servers, data, providing marketing assistance, processing credit card payments, and providing customer service.
x. These companies and individuals will have access to your personal information as may necessary to perform their functions, but they may not share that information with any other third party.
xi. We disclose information if legally required to do so, if requested to do so by a governmental entity or if we believe in good faith that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.
xii. We may disclose and transfer information to a third party who acquires any or all MY CITY app's business units, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets.
xiii. In addition, in the event MY CITY app becomes the subject of a bankruptcy proceeding, whether voluntary or involuntary, MY CITY app or its liquidator, administrator, receiver or administrative receiver may sell, license or otherwise dispose of such information in a transaction approved by the court.
xiv. You will be notified of sale of all or a substantial portion of our business to a third party via e-mail or through a prominent notice posted on the Site/mobile applications.
J. SECURITY OF YOUR PERSONAL DATA
i. We are committed to ensuring that your personal data is stored securely. To the extent that you have provided (or will provide) personal data about your family members, spouse, other dependents (if you are an individual), directors, shareholders, employees, representatives, agents (if you are a corporate, an entity or an organisation) and/or other individuals, you confirm that you have explained (or will explain) to them that their personal data will be provided to, and processed by, us and you represent and warrant that you have obtained their consent to the processing (including disclosure and transfer) of their personal data in accordance with this Privacy Policy.

In respect of children (i.e. individuals under the age of 18 or under the age of majority in your country) or individuals not legally competent to give consent, you confirm that you are the parent or legal guardian or person who has parental responsibility over them or the person appointed by court to manage their affairs or that they have appointed you to act for them, to consent on their behalf to the processing (including disclosure and transfer) of their personal data in accordance with this Privacy Policy.
L. TRANSFER OF YOUR PERSONAL DATA OUTSIDE OF YOUR COUNTRY
Our information technology storage facilities and servers may be located in other countries outside of your country. This may include, but not limited to, instances where your personal data may be stored on servers located outside of your country. M. INTERNET AND MOBILE APPLICATION USE
i. You acknowledge that the provision of your personal data to us over the Internet is entirely at your own risk.
ii. You further acknowledge that if you post your rating and/or review on the Platform, your rating and/or review will become a public information and will be retained by us even after your account has been terminated. Your email address and phone number will not be visible to others through any rating and/or review that you post.
iii. If any part of the Platform links you to other websites/mobile applications, those websites do not operate under this Privacy Policy and we do not accept any responsibility or liability arising from those websites/mobile applications. We suggest you to read and understand those websites’/mobile applications’ privacy policy before you provide your personal data to those websites/mobile applications.
iv. We use cookies (an alphanumeric identifier that we transfer to your computer’s or mobile device’s hard drive so that we can recognise your web browser or mobile device, track your visits to the Platform or remember your username and/or password each time log-in) to monitor your use of the Platform. All such demographic data collected through cookies are not personal data and we may use this data in aggregated, statistical and/or anonymised form. You may disable cookies by changing the settings on your web browser or mobile device, although this may mean that certain features on the Platform will not function properly if you set your web browser or mobile device to not accept cookies.

Android devices will notify you of the permissions that our mobile application seeks before you first use the mobile application, and your use constitutes your consent.

The Platform may integrate with social sharing features and other related tools which allow you to share information with your friends or the public, depending on the settings you establish with the social sharing network. The social sharing network’s use of your personal data made available by MY CITY or MY CITY app is governed by that social sharing network’s privacy policy, not by this Privacy Policy. By connecting your social sharing network account through the Platform, you agree that we may collect your personal data from your social sharing network account only in accordance with your privacy settings you have set up under your social sharing network account and for the Purposes provided under this Privacy Policy.
viii. We may automatically receive, record and store location services information from your computer or mobile device when you interact with us. You hereby consent to our use of anonymised location services information collected from you. Where the location services information is personally identifiable, we will give you the options to manage your disclosure of this information. Depending on the functionalities available on your computer or mobile device, you may benefit from advanced options to manage the location services information. A computer or mobile device may report its GPS location at the time you interact with us if the location services settings are enabled. Such information is not identified as personal data, except where we are required to do otherwise under applicable law.
ix. Our collection of your computer or mobile device location information is solely at your discretion. You can enable or disable location services when you use the Platform at any time, through your computer or mobile device settings. Should you use the Platform with location services enabled, you consent to our collection and dissemination of your computer or mobile device location information through the Platform, as specified in this Privacy Policy. Under no circumstances shall we be liable for claims or for any damages therefrom, arising out of your informed decision to allow other users to see your computer or mobile device location information, as specified in this Privacy Policy.
N. Use of Cookies
i. The Site/mobile applications may use third-party vendors to serve or track advertisements on Web sites/mobile applications. Among other things, these third parties may use cookies, pixel tags and other technologies to enable such third parties to record which ads your browser/mobile applications has loaded and which pages you may have been viewing when the ads were delivered or accessed. The information collected through these functions is subject to the privacy policies of those third parties.
ii. The Site/mobile applications and the ASP may use a tracking technique that employs embedded URLs to allow use of the Site/mobile applications without cookies. Embedded URLs allow limited information to follow you as you navigate the site/mobile applications but is not associated with personal information and is not used beyond the session.
iii. The Site/mobile applications and the ASP may use embedded pixel technologies on selected pages for the purposes of identifying unique user visits to the Web sites/mobile applications, as opposed to aggregate hits, and to identify the pages viewed. If you choose to decline cookies, however, that may hinder performance and negatively impact your experience on the Site/mobile applications.
